Estate Planning, Wills & Trusts

Proper estate planning with an attorney is the best way for  to ensure that your assets will be managed and distributed after your death in the manner you specify. Also, a properly designed plan can reduce or avoid the costs and time involved with probate administration.  If your estate is large enough to be subject to federal estate taxes, a proper plan can avoid or minimize estate taxes, to allow more assets to pass to your family.  Column

In order to recommend the best plan for you, we will gather some information fromyou about your family, testamentary intentions, and estate.  Based upon that information, a comprehensive estate plan, taking into account all the relevant considerations, will be recommended to you. An alternative plan -- and its relevant pros and cons -- may also be discussed.  The costs of any plan discussed will also be explained.  

Once a plan is agreed upon, we will prepare the required documents to put your plan into effect.  Such documents can include a will, revocable or living trust, joint trust, irrevocable life insurance trust, trust for minors, Crummey trust, trust for grandchildren, power of attorney, health caresurrogate designation, pre-need guardian designation, enhanced life estate deed (Lady Bird deed), deed to trust, trust certificate, assignment, and living will (advanced medical directive).  Each document which is part of your plan will be fully explained to you before you sign it.

Probate and Trust Administration 

When a person dies, if he or she leaves a will, it may have to be administered in court. We handle all matters related to the administration of a will or trust, including:

Guardianship

A guardian is a court-appointed individual who is charged with being responsible for an incapacitated person and the person's property, under the supervision of the court. We represent clients in filing petitions to determine incapactiy and for appointment as guardian of the person and/or property of an incapacitated adult or minor and all other matters related to the guardianship proceedings.

Will & Trust Litigation

Sometimes relatives who have been left out of a will or trust, or who are unhappy with their share of an estate, challenge the legitimacy of the will or trust. Sometimes there are disputes among the beneficiaries of a will or trust as to certain matters related to the administration or distribution of the estate.  We are experienced in representing clients in all kinds of estate litigation matters, including probate litigation, trust litigation and will contests.
